Navigating the New 2026 Rental Pet Laws in NSW: What Landlords and Tenants Need to Know

The rental landscape in New South Wales is undergoing significant reform. Following the NSW Parliament passing the Residential Tenancies Amendment (Protection of Personal Information) Act 2026, important updates are officially rolling out across the state.

While the majority of this landmark Bill introduces strict new tenant privacy protections set to take effect in early 2027, a crucial new provision regarding pet approvals bypassed the wait and officially commenced on 2 October 2026.

What Changed on 2 October 2026?

The new legislation fundamentally shifts the approval process for tenants who wish to keep a pet in their rental property.

Under the new laws, when a tenant submits a formal request to keep a pet, a strict, time-bound approval process applies:

  • The 21-Day Clock: Once a tenant submits a pet request, landlords and property managers have exactly 21 days to respond.

  • Reasonable Refusals Only: A landlord cannot simply say "no" without cause. If an owner wishes to refuse a pet request, they must apply to the NSW Civil and Administrative Tribunal (NCAT) within that 21-day window to seek an order allowing them to refuse the request. NCAT will only grant the order under specific, reasonable grounds (such as the property being fundamentally unsuitable for that specific type of animal, or strict strata by-laws prohibiting pets).

  • Deemed Consent: If a landlord fails to respond or take action within the 21 days, consent is automatically deemed to be given, and the tenant is legally permitted to have the pet on the premises.

Note: These provisions apply specifically to new tenancies and new pet approval requests handled from 2 October 2026 onward.

Why Is This Happening Now?

The NSW Government fast-tracked these pet provisions ahead of the broader Bill to provide immediate certainty to thousands of pet-owning renters across the state. With vacancy rates low and pet ownership at an all-time high, the law aims to establish a fairer, more transparent framework that prevents arbitrary denials while still protecting property owners through an independent tribunal review process (NCAT).

What About the Privacy Reforms?

If you have been hearing a lot about major new penalties regarding how rental applications and tenant data are stored, don’t panic just yet.

Most of the sweeping reforms in the Protection of Personal Information Act—such as mandatory data minimisation, strict 3-month destruction timelines for unsuccessful applicant data, and limits on what information agencies can ask for—will not commence until early 2027.
